1. Interpretation and Definitions
Interpretation
Words with capitalized initial letters have meanings defined under the following conditions. These definitions shall have the same meaning regardless of whether they appear in singular or plural.
Definitions
For the purposes of these Terms and Conditions:
- Company (referred to as “the Company”, “We”, “Us” or “Our”) refers to REVE CHOCOLATIER FOR CONFECTIONARY & CHOCOLATE TRADING, Dubai, United Arab Emirates.
- Website refers to Reve Chocolatier, accessible from www.revechocolatier.com.
- Service refers to the Website.
- Goods refer to edible chocolate and confectionery products offered for sale on the Service.
- Order means a request by You to purchase Goods from Us.
- You means the individual or legal entity accessing or using the Service.
- Account means a unique account created for You to access parts of the Service.
- Country refers to the United Arab Emirates.
- Device means any device capable of accessing the Service.
2. Acknowledgement
These Terms and Conditions govern the use of this Service and constitute a binding agreement between You and the Company. By accessing or using the Service, You agree to be bound by these Terms. If You do not agree with any part of these Terms, You may not access the Service.
You confirm that You are at least 18 years of age.
Your use of the Service is also conditioned on Your acceptance of Our Privacy Policy, which explains how We collect, use, and protect Your personal data.
3. Placing Orders for Goods
By placing an Order through the Service, You confirm that You are legally capable of entering into binding contracts.
All Orders are subject to availability and acceptance by the Company. An Order is considered accepted only after it has been confirmed or dispatched by Us.
4. Your Information
When placing an Order, You may be required to provide personal and payment information, including Your name, email address, phone number, billing address, shipping address, and payment details.
You represent and warrant that:
- You have the legal right to use the payment method provided; and
- All information You provide is accurate, complete, and up to date.
By submitting this information, You authorize Us to share it with payment service providers solely for the purpose of processing Your Order.
5. Order Cancellation
We reserve the right to refuse or cancel an Order at any time for reasons including but not limited to:
- Product unavailability
- Errors in pricing or product description
- Errors in the Order
- Suspected fraud or unauthorized transactions
- Delivery or logistical limitations related to perishable goods
If an Order is cancelled after payment has been processed, a full refund will be issued using the original payment method.
6. Returns, Refunds and Cancellations (Food Products)
Due to the perishable, edible, and hygienic nature of chocolate and confectionery products, the following policy applies:
- No returns or exchanges are accepted once Goods have been delivered.
- Refunds or replacements may be offered only if:
- The Goods are damaged upon delivery
- Incorrect items were delivered
- Items are missing from the Order
Any issue must be reported within 24 hours of delivery, accompanied by clear photographs and the Order number.
Refunds, if approved, will be processed using the same payment method used for the original Order.
No Refunds or Replacements Will Be Issued For:
- Customer unavailability at delivery
- Incorrect delivery information provided by the customer
- Delays in acceptance causing melting or quality changes
- Natural variations in appearance of handmade chocolate products
7. Temperature, Storage and Delivery Disclaimer
Chocolate products are heat-sensitive. Customers are responsible for ensuring availability to receive the Order at the delivery address.
The Company shall not be responsible for melting, texture changes, or quality issues resulting from:
- Delivery delays beyond Our control
- Customer unavailability
- Incorrect address or contact details
Customers must store products in a cool, dry place away from direct sunlight. Natural variations in texture, color, or finish may occur.
8. Allergen and Food Safety Disclaimer
Our products may contain or come into contact with allergens including milk, nuts, gluten, soy, eggs, sesame, or other allergens. Products are prepared in facilities that may handle multiple allergens.
While care is taken, cross-contamination cannot be guaranteed to be eliminated.
Customers are responsible for reviewing ingredient and allergen information before placing an Order. The Company does not provide medical or dietary advice and is not responsible for allergic reactions.
9. Availability, Errors and Inaccuracies
We strive to provide accurate product information; however, errors may occur. Product descriptions, images, pricing, and availability may change without notice.
We reserve the right to correct any errors, inaccuracies, or omissions and to cancel Orders affected by such issues.
10. Prices Policy
Prices may be changed at any time before an Order is accepted.
If a price change occurs due to customs duties, shipping costs, government action, or other factors beyond Our control, You will have the right to cancel the Order prior to dispatch.
11. Payments
Payments may be made using the payment methods available at checkout, including major credit and debit cards and approved online payment gateways.
All payments are subject to authorization by the payment provider. Failure to obtain authorization may result in Order cancellation.
12. Delivery and International Shipments
Delivery times are estimates only and are not guaranteed.
International shipments may be subject to customs inspections, import taxes, and duties, which are the responsibility of the customer.
The Company is not responsible for delays caused by customs clearance or third-party delivery services.
Orders returned due to failed delivery attempts or incorrect address details may not be refundable.
13. User Accounts
When creating an Account, You must provide accurate and current information at all times.
You are responsible for safeguarding Your account credentials and for all activities conducted under Your Account.
The Company reserves the right to suspend or terminate Accounts that violate these Terms.
14. Links to Other Websites
The Service may contain links to third-party websites. The Company has no control over and assumes no responsibility for the content, policies, or practices of any third-party websites.
15. Termination
We may terminate or suspend Your Account or access to the Service immediately, without prior notice, if You breach these Terms.
Upon termination, Your right to use the Service will cease immediately.
16. Limitation of Liability
To the maximum extent permitted by applicable law, the Company’s total liability shall be limited to the amount paid by You for the Order.
The Company shall not be liable for indirect, incidental, consequential, or special damages, including loss of profit, data, or business interruption.
Nothing in these Terms limits rights that cannot be excluded under UAE law.
17. “AS IS” and “AS AVAILABLE” Disclaimer
The Service and Goods are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, to the maximum extent permitted by law.
Handmade chocolate products may vary in appearance and texture.
18. Governing Law
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates.
19. Dispute Resolution
If You have any dispute regarding the Service, You agree to first attempt to resolve it informally by contacting the Company.
20. Severability and Waiver
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
Failure to enforce any right shall not constitute a waiver of that right.
21. Translation Interpretation
If these Terms are translated, the English version shall prevail in case of any dispute.
22. Changes to These Terms and Conditions
We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
